BSA Secures Precedent-Setting Copyright Infringement Ruling for Member in China
On April 24, a 3-judge panel of the Beijing IP Court awarded BSA member Dassault Systèmes RMB 20 million (roughly USD $2.9 million) in a software infringement matter involving Beijing IAT Automobile Technology Co., Ltd. (“IAT”). During a court-directed evidence preservation procedure, IAT attempted to conceal its use of infringing software through a virtual desktop software installed on its network. Thanks to the careful work of BSA and its outside counsel, the court discovered this concealment and ruled that it constituted obstruction. The court’s judgment incorporated this obstruction finding. BSA counsel is now working to negotiate a settlement that will result in legalization sales for the members involved.
