Significant Court Decision for Member Company in Thailand

BSA’s Compliance Solutions team in Thailand secured a significant court decision in a case that has been ongoing since 2019. The BSA team pursued this case through multiple phases, including an initial investigation of the report, inspection of the company’s premises which revealed over USD$100,000 worth of infringing BSA member products, and the filing of a civil case at the IP Court in Bangkok after the company refused to comply with a settlement agreement. Following a decision by the Court in 2022 awarding significant damages, the target company again refused to negotiate a settlement and filed an appeal. In August 2023, the Appeals Court upheld the decision of the IP court. BSA and its counsel will now seek to leverage this appellate decision to drive a settlement in which the infringer will finally purchase licenses for the software it has been using.
